When standard programs aren't enough
Labour Agreements are formal arrangements between the Australian Government and an employer (or industry body) that allow the employer to sponsor overseas workers in occupations or under conditions not available through standard visa programs.
They are typically used in industries experiencing genuine workforce shortages that cannot be filled from the local labour market, and where standard visa programs don't provide an adequate solution — whether because the occupation isn't on the relevant skills list, the salary requirements can't be met, or the workforce need is too specialised.
Negotiating a Labour Agreement is a complex, evidence-intensive process. It requires a compelling business case, detailed labour market analysis, and sustained engagement with the Department of Home Affairs. Done well, it can unlock workforce solutions that simply aren't available any other way.
Types of Labour Agreements
Company-Specific Labour Agreements
Negotiated directly between an individual employer and the Department of Home Affairs. Tailored to the specific circumstances of the employer and their workforce needs.
Industry Labour Agreements
Developed by industry bodies in consultation with the Department. Employers in the relevant industry can then access the agreement without negotiating their own.
On-Hire Labour Agreements
Designed for labour hire companies that place workers with host businesses. Allows the labour hire company to sponsor workers on behalf of multiple host employers.
